Parenting Time Expeditor Services

When a couple has difficulty interpreting the parenting time portion of their custody agreement, they may choose, or a judge may decide, they need the assistance of a Parenting Time Expeditor like those at CMG Mediation and Family Services. The Parenting Time Expeditor will make binding decisions regarding parenting time when parents are unwilling or unable to agree. Although the Parenting Time Expeditor must be appointed by the court, parents have the flexibility to mutually agree on the choice of their Parenting Time Expeditor.

When a situation arises where parents are unable to agree or compromise in a parenting time dispute, one or both may request that the Parenting Time Expeditor make the decision for them. Situations involving a Parenting Time Expeditor are far from ideal, but they can help you resolve tension and bring clarity to conflicting interpretations of parenting time plans. CMG Mediation and Family Services will help you get through these situations promptly and without the need to wait for a court date.  ​

How does the Parenting Time Expeditor process work?

The parenting time expeditor usually meets with both of you, together or separately, and listens to each side of your dispute.  Once an expeditor understands both perspectives, he/she tries to come up with a solution to which both of you can agree.  In situations where the dispute requires an immediate resolution, the expeditor can talk with the both of you through a conference call or similar means.

If you can’t reach an agreement, the expeditor generally has five days after receiving all the necessary information to make a decision that resolves the dispute. The expeditor has the power to award compensatory parenting time, and may recommend to the court that the noncomplying parent pay attorney's fees, court costs, and other costs, if the parenting time order has been violated.

The expeditor puts your agreement or his/her decision in writing and provides a copy to both of you.  This agreement or decision is binding on both of you unless it is vacated or modified by the court.  If one of you does not comply with any agreement or decision of the expeditor, either of you may bring a motion with the court.  The court has the option to enforce, modify, or vacate your agreement or the expeditor’s decision.

In most situations, the parenting time expeditor makes decisions that interpret or clarify a parenting time order.  In some situations, this includes the developing a specific schedule when language in the existing court order grants "reasonable parenting time."
